Pawtrait Studio is a product of Elite Tech Global, LLC ("Company", "we", "our", or "us"). By using Pawtrait Studio, you ("User", "you", or "your") agree to these Terms of Service. Please read them carefully.

Eligibility

You must be at least 13 years of age to use Pawtrait Studio. By using our service, you represent and warrant that you are at least 13 years old. If you are under 18, you represent that you have your parent or guardian's permission to use the service. We reserve the right to terminate accounts of users who misrepresent their age.

Service Description

Pawtrait Studio transforms pet photos into custom AI-generated artwork, which can be printed on canvas products and shipped to your address. The service is accessed through ChatGPT or our website.

Acceptable Use

You agree to:

• Only upload photos of pets you own or have explicit permission to use
• Not upload images containing inappropriate, offensive, illegal, or harmful content
• Not use the service to infringe on any third party's intellectual property rights
• Not attempt to reverse engineer, hack, or disrupt our service
• Use generated artwork for personal, non-commercial purposes only

Orders & Payment

• All prices are displayed in USD and include shipping to supported destinations
• Payment is processed securely via Stripe
• By placing an order, you authorize us to charge your payment method
• Orders are final once submitted for production and cannot be cancelled
• We reserve the right to refuse or cancel orders at our discretion

Shipping & Delivery

• Estimated production time: 2-5 business days
• Estimated shipping time: 5-10 business days after production
• We currently ship to the United States, Canada, United Kingdom, and Australia
• Shipping delays due to carriers, customs, or circumstances beyond our control are not our responsibility
• Risk of loss transfers to you upon delivery to the carrier

Refunds & Returns

• Due to the custom nature of our products, we generally cannot accept returns or issue refunds
• If your order arrives damaged or defective, contact us within 7 days with photos for a replacement
• Refunds or replacements are issued at our sole discretion for verified quality issues
• We are not responsible for orders shipped to incorrect addresses provided by you

Intellectual Property

You retain all rights to photos you upload. By uploading, you grant us a limited license to process the image for artwork generation. Generated artwork is created using AI technology; you receive a personal-use license for the physical product you purchase. You may not reproduce, sell, or commercially exploit the generated artwork.

Disclaimer of Warranties

PAWTRAIT STUDIO IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We do not guarantee that the service will be uninterrupted, error-free, or that AI-generated results will meet your expectations.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ELITE TECH GLOBAL, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. Our total liability shall not exceed the amount you paid for the specific order giving rise to the claim.

Indemnification

You agree to indemnify and hold harmless Elite Tech Global, LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the service, violation of these terms, or infringement of any third party's rights.

Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to this page. Your continued use of the service after changes constitutes acceptance of the modified terms. We encourage you to review these terms periodically.

Termination

We may suspend or terminate your access to the service at any time, without notice, for conduct that we believe violates these terms or is harmful to other users, us, or third parties.

Dispute Resolution

Any disputes arising from these terms or your use of the service shall first be attempted to be resolved through informal negotiation. If unresolved after 30 days, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that you may bring claims in small claims court if eligible.

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Utah, United States, without regard to conflict of law principles.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
